1. Acceptance of Terms

By accessing or using Nesta Market ("the Platform"), operated by Wade Technology ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

Nesta Market is an AI-powered e-commerce platform that enables users to create, manage, and operate online stores. Services include product management, AI-powered content generation, store cloning, payment processing integration, analytics, and order management.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.

You must be at least 18 years old or the legal age in your jurisdiction to use the Platform.

4. Subscription & Billing

Paid plans are billed monthly. You authorize us to charge your payment method on a recurring basis. You can cancel at any time; cancellation takes effect at the end of your current billing period.

We reserve the right to change pricing with 30 days notice. Existing subscribers will be notified before any price changes apply.

5. Acceptable Use

You agree not to:

• Sell illegal products or services through your store
• Infringe on intellectual property rights of others
• Use the Platform for fraudulent activities
• Attempt to gain unauthorized access to the Platform
• Use automated tools to scrape or extract data beyond API access
• Resell Platform access without an Enterprise agreement

6. Your Content

You retain ownership of all content you upload to the Platform, including product images, descriptions, and store data. You grant us a license to host, display, and process your content as necessary to provide the Platform services.

For AI-powered features, your product data may be processed by third-party AI providers. This data is used solely for generating your requested outputs and is not used to train third-party models.

7. Store Cloning

The Store Cloning feature extracts publicly available product information from third-party websites. You are responsible for ensuring you have the right to use any cloned content. We are not responsible for intellectual property disputes arising from cloned store data.

8. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. We are not liable for lost revenue, data loss, or indirect damages arising from your use of the Platform. Our total liability is limited to the fees you paid in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account for violation of these terms. Upon termination, you may request an export of your store data within 30 days. After 30 days, data may be permanently deleted.

10. Changes to Terms

We may update these terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
